TWO WEEKS IN COSTA RICA, INC. TERMS AND CONDITIONS

We are Two Weeks in Costa Rica, Inc. and we look forward to the opportunity to act as the booking agent for your travel needs. Before we finalize arrangements for your accommodations, transportation, tours, or other services, we require that you review this agreement. These terms and conditions describe what you are legally entitled to expect from us when you purchase travel-related services through us, in addition to your obligations as a customer. The terms “we,” “us,” and “our” refer to Two Weeks in Costa Rica, Inc. The term “you” refers to the customer visiting our website, booking a reservation through us, or otherwise using our services. Your payment of your invoice will signify your agreement with the following terms and conditions:

We act as an intermediary or booking agent for products and services that are not directly supplied by us (e.g., hotels, vacation rentals, shuttle transportation, boat transportation, tours). You will be entering into a separate contract with each service provider named in your invoice (“Service Provider”), in connection with such products and services.

Reservation Terms

Bookings

We accept bookings through our website’s online booking system and directly through customer interactions via email. When you request a booking or make an online order, we will work with the applicable third-party Service Provider(s) to secure your reservation(s).

Order Confirmation, Payment, and Fulfillment

Once we confirm availability with the applicable third-party Service Provider(s) , we will send you an invoice for the amount due or order notification containing a payment link. Orders will not be fulfilled until they are paid. Once you make the payment, you will receive another email confirming the services. If no payment is made, the service(s) requested will be cancelled.

Payments made to us are processed through a third-party payment processor. We use PayPal, Stripe (credit card processor), and Zelle to accept payments. Everything is processed through the payment processor’s secure website. Learn more by reading our Privacy Policy.  

Deposits

Some bookings may require a deposit from you. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can be guaranteed only once we receive full payment, subject to any terms and conditions of the Service Provider. We will advise you of the date that full payment is required. Upon your provision of your payment information, you are authorizing us to make the payment arrangements with the corresponding Service Provider.

Requesting Reviews

As part of our booking service, we may ask you to review the tour, shuttle, or other service provided to let us know about your experience. This helps ensure customer satisfaction. By using our booking service, you agree to receive review invitations. You are under no obligation to write a review.

Changes and Cancellations

Service Providers have different policies regarding modification and cancellation of bookings. Refer to the terms and conditions of your invoice for the specific policies that apply to your reservations.

If the reason for your cancellation is covered under the terms of your travel insurance policy, you may be able to reclaim any cancellation charges through your insurer.

Service Providers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. By paying your invoice, you hereby consent to those terms and conditions.

Your contract with your Service Provider(s) may allow them to cancel or amend bookings. We will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure, but we accept no liability for any changes or costs incurred that may result. Subject to the Service Provider’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Service Provider, or canceling your booked arrangements and receiving any applicable refunds. We do not guaranty that any refunds will apply.

Refunds

If you cancel a booking within the cancellation deadlines, you may be entitled to a partial refund. We require at least 24 hours’ notice in advance of the cancellation deadlines of the Service Provider(s) provided in your invoice. All cancellation requests must be received in writing (email: bookings@twoweeksincostarica.com).

The amount of the refund will be the price you paid for the cancelled service minus the cancellation fee. Cancellation fees for each service are detailed in your invoice.

Any refunds will be paid once we have received the funds back from the Service Provider(s). Your refund will be processed through the same third-party payment processor used to make the original payment.

Travel Information

It is your responsibility to ensure that all of the details on your itinerary are correct and to bring to our attention any errors or discrepancies immediately.

Destinations, and Passport, Visa, and Immigration Requirements

Although most travel to Costa Rica is completed without incident, travel to any destination involves risk. We urge you to review travel prohibitions, warnings, announcements, and advisories issued by government agencies prior to booking travel. Information on conditions in Costa Rica and the level of risk associated with travel to Costa Rica, including due to COVID-19, can be found by visiting the US Department of State’s website and the US Embassy’s website. For medical and health information about travel to Costa Rica, visit the Center for Disease Control and Prevention’s website. By offering to book travel services in Costa Rica, we do not represent that travel in such destination is safe or without risk.

You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination(s). We do not accept any responsibility in the case of you being unable to travel due to not complying with any such requirements.

Travel Insurance

For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance.

Disclaimers, Indemnity, and Assumption of Risk

THE SERVICE PROVIDERS ARE INDEPENDENT CONTRACTORS AND NOT OUR AGENTS OR EMPLOYEES. WHILE WE STRIVE TO WORK WITH ONLY THE BEST SERVICE PROVIDERS, WE ARE NOT RESPONSIBLE FOR THE ACTS OR OMISSIONS OF THE SERVICE PROVIDERS. WE ASSUME NO RESPONSIBILITY FOR AND SHALL NOT BE LIABLE FOR ANY REFUND, PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSS, ACCIDENT, DELAY, INCONVENIENCE, OR IRREGULARITY, WHICH MAY BE CAUSED BY: (1) ANY DEFAULTS, WRONGFUL OR NEGLIGENT ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, OR WARRANTIES OF THE SERVICE PROVIDERS; (2) ANY DEFECT IN OR FAILURE OF ANY VEHICLE, CRAFT, EQUIPMENT, OR INSTRUMENTALITY OWNED, OPERATED, OR OTHERWISE USED OR PROVIDED BY THE SERVICE PROVIDERS; (3) ANY WRONGFUL OR NEGLIGENT ACTS OR OMISSIONS ON THE PART OF ANY OTHER PARTY NOT UNDER OUR CONTROL; AND (4) ANY SERVICE PROVIDER PRICE DROP AFTER YOUR TRAVEL ARRANGEMENTS HAVE BEEN CONFIRMED, PAID IN FULL, OR TICKETED. WE HAVE NO LIABILITY AND WILL MAKE NO REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, OVERBOOKING, STRIKE, FORCE MAJEURE, NATURAL DISASTER, OR OTHER EVENTS BEYOND OUR CONTROL, AND WE HAVE NO RESPONSIBILITY FOR ANY ADDITIONAL EXPENSE, OMISSIONS, DELAYS, REROUTING OR ACTS OF ANY GOVERNMENT OR AUTHORITY.

YOU ACKNOWLEDGE AND AGREE THAT WE HAVE PERFORMED REASONABLE DUE DILIGENCE INTO HELPING YOU SELECT THIRD-PARTY SERVICE PROVIDERS, BUT THAT IN EACH OCCASION THE ULTIMATE DECISION TO SELECT SPECIFIC REQUESTED SERVICES AND ENGAGE SPECIFIC THIRD-PARTY SERVICE PROVIDERS IS SOLELY AND EXCLUSIVELY YOUR DECISION, AND IS BASED ON YOUR OWN INVESTIGATION INTO THE OPTIONS AVAILABLE, AND NOT SOLELY ON THE ADVICE OR RECOMMENDATION OF US. ADDITIONALLY, THE ACTIVITIES INVOLVED IN THE REQUESTED SERVICES MAY INVOLVE DANGEROUS ACTIVITIES, UNFAMILIAR LOCATIONS, AND OTHER RISKS ASSOCIATED WITH TRAVELING ABROAD. PLEASE BE AWARE THAT YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR YOUR OWN WELL BEING AND FOR YOUR BELONGINGS AND POSSESSIONS, AND THAT YOU ARE ENGAGING IN EACH OF THE REQUESTED SERVICES AND RELATED ACTIVITIES AT YOUR OWN RISK, AND YOU HEREBY EXPRESSLY ASSUME THAT RISK.

BY CONTINUING WITH PAYMENT, YOU VOLUNTARILY, KNOWINGLY, AND WILLINGLY ASSUME ALL RISK AND FULL RESPONSIBILITY FOR ALL THAT MAY OCCUR DURING TRAVEL, WHETHER KNOWN OR UNKNOWN, AND HEREBY AGREES TO DEFEND, INDEMNIFY, AND HOLD US HARMLESS AGAINST ANY SUCH DAMAGES, LOSSES, OR INJURIES TO YOU AND ALL OTHER TRAVELERS THE REQUESTED SERVICES APPLY TO. YOUR PAYMENT INDICATES CONSENT TO THE ABOVE TERMS AND CONDITIONS AND ON BEHALF OF ALL ACCOMPANYING TRAVELERS AND AGREES TO CONVEY THE CONTENTS OF THIS AGREEMENT TO ALL OTHER TRAVELERS THE ABOVE SERVICES REQUESTED MAY APPLY TO.

General

These terms and conditions are governed by the laws of the State of Florida and the laws of the United States applicable therein. You agree that the courts in the State of Florida will be the exclusive jurisdiction for all claims brought by you or us, and you hereby submit to the personal jurisdiction of those courts.
